July 16, 2004: OLC Discusses Ramification of Supreme Court Decision with Attorney General
Jack Goldsmith, the head of the Justice Department’s Office of Legal Counsel (OLC), sends a classified memo to Attorney General John Ashcroft. The contents of the memo remain secret, but the American Civil Liberties Union (ACLU) will later learn that the memo concerns the ramifications of a recent Supreme Court decision on gathering foreign intelligence. Presumably, Goldsmith is writing about the Hamdi decision, in which the Court ruled that enemy combatants and detainees have the right to due process in the US justice system (see June 28, 2004), but this is by no means certain.
