September 22, 2006: Libby Team Wants Expansive Access to Classified Documents
The Libby defense team, apparently responding to an encouraging order from Judge Reggie Walton (see September 21, 2006), files a motion expanding on its stated intention of introducing a raft of classified information into evidence during Lewis Libby’s upcoming trial. The defense argues that it needs wide latitude in having access to classified documents from the White House, the CIA, and other government agencies and organs, since it cannot anticipate what the prosecution will attempt to do during the trial. The defense also states that Libby intends to testify at trial. [US District Court for the District of Columbia, 9/22/2006
